STROM, District Judge. Rowland F. Zerba, Jr., was indicted by the federal grand jury for the Southern District of Iowa in a six count, superseding indictment. He appeals from his convictions of conspiracy to distribute methamphetamine in violation of 21 U.S.C. § 846 (Count 1), possession with intent to distribute methamphetamine in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2 (Count 2), and of harboring a fugitive in violation of 18 U.S.C. § 1071 (Count 5). Zerba also appeals the district court's application of the United States Sentencing Guidelines. Zerba does not appeal his convictions under 18 U.S.C. § 924(c)(1), (2), for the use of a firearm during and in relation to drug trafficking (Count 3) or for being a felon in possession of a firearm in violation of 18 U.S.C. § 922(g)(1) (Count 6). Zerba was not charged in Count 4.
